I have the honour to acknowledge your letter

of 23rd. May, 1908, enclosing a Memorandum of the advice given by Your Honour to the Executive Council relative to the carrying out of capital punishment on women, and requesting its trans-

-mission to the Secretary of State.

In this Memorandum Your Honour says "I

stated however that I believed that in cases of child-murder

women were rarely hung except in extreme cases, but that I

could go no further than this". As this did not coincide with

my own recollection of the advice given by Your Honour I refer-

-red the point to the Executive Council at its last meeting. The

members were unanimously agreed that Your Honour stated at the

former meeting on 4th. February, 1908, that you did not know of

any case in which a capital sentence had been carried out upon

a female. The Secretary of State was so informed. It is as Your

Honour says of great importance that no misapprehension should

exist on so important a matter, and I have therefore considered it proper to inform you of these facts. Your letter under reply (together with a copy of this), shall be forwarded to the Secretary of State at an early date, in accordance with your

request.
